Lawn Mowing Terms & Conditions

Carefree Mowing-Early Cancellation Policy
Carefree Mowing is a season long service. Our mowing season runs until the grass stops growing or leaf fall becomes heavy enough to prohibit mowing. In 2021, our mowing season ended November 16th.

If you choose to cancel your Carefree Mowing services, MowCow will recalculate the cost of all mows you have received at the retail price. If your first cut of the season required a double-cut because of excessively tall grass, the double-cut will be treated as two individual mows. You will then receive a final statement showing whether you have an outstanding balance or a refund due.

Long Grass Policy
There are times when our first cut for you takes longer than a normal cut. It could be that it’s been awhile since the last cut. It could be that the grass is growing fast due to ideal weather conditions. While it doesn’t always happen, if our first visit requires a second cut, we reserve the right to charge up to 2x the original price to allow for the extra time needed.

Spring and Inclement Weather Policy
We set our mowing routes up as Monday through Friday.  We use Saturdays to catch up on lawns if weather has delayed us during the week. However, when Mother Nature delays our ability to mow on time, we may mow your property twice within a 7 day period to maintain quality and to get back on schedule. This does not change the total number of mows received in the season, but does change the timing of those mows.

For example, if you were on our Wednesday route and it rained, we would be out the next day that weather permitted.  If that meant it was a Thursday, then all of our routes for the rest of the week would shift by a day. Our Friday Route might get done on Friday (because we typically run extra crews to catch up) or it might be Saturday for just that week.

Two or more days of rain might push your mow day into the next week. If that were a Monday and the grass is growing at a high rate, you might see us again towards the end of the week to make sure that your lawn stays healthy and looking great. Once the weather evens out and the grass is under control, we would go back to the usual schedule.

General Landscape Terms & Conditions

Drainage Warranty

Drain Pipe Installation:
MowCow warrants that the buried drain pipes will be free from defects in the area repaired for a period of 3 years, all of which is non-transferable. Some maintenance is necessary with certain products. If there are catch basins or channel drains present, it is necessary to blow off or otherwise keep the surface grates clear of obstructions. Most landscapers are familiar with this and will simply blow off the surface of any drain grates regularly. If the drain grates are allowed to clog on the surface, pooling should be expected.

It is also important to not cover or obstruct the exit of the drain line. Some people will cover the end of the pipe at its exit point for one reason or another. Solid debris moves through these systems from the gutters and downspouts. Any covers over the end of the pipe will trap this solid debris.

French Drains require a slightly different type of maintenance to keep the aggregate reasonably clear of sediment and debris to allow water to move into the system. That’s because French drains depend on clear, open aggregate to move water into the pipe. It may be necessary to remove and clear this aggregate from time to time.

MowCow can not guarantee that water will not change flow pattern and further solutions may not be required. Our systems are designed based on our opinions, our best experience, and the information gained from meeting with the homeowner. A determination will be made as to the most appropriate pipe size and capacity/volume of the system to balance the function, cost, and impact on the property. It is always possible to have a system backup or for the system to fail due to overwhelming conditions outside our control, including severe storm-water conditions, local or area flooding, hurricanes, other acts of God and nature, or even the misrepresentation of the issue by the homeowner and/or any other human error.

Bamboo Removal
MowCow will do our best to remove all visible spouts and culms from the areas specifically designated in the agreed upon. Bamboo is an aggressive and invasive plant. Because deep bamboo rhizomes will continue to travel underground and resprout, MowCow will not warrant free return visits once our specialist has left the property.

Bamboo does not respect property lines and can easily spread to neighboring yards, damaging established plantings and trees, pools, patios, decks, sidewalks, sheds, walkways, driveways and even foundations. Cutting the shoots and culms at ground level is a temporary solution and will not suffice for effective long term bamboo removal.

Customer understands the nature of aggressively spreading bamboo plants and understand that MowCow can not guarantee that this plant will not come back after we have completed the removal service which you have hired us to do.

The customer also understands that any further steps to remove the bamboo will be no fault of MowCow. If further removal after initial visit day is desired, all additional visits will be charged to the client. There is no warranty or guarantee on bamboo removal service.

Marking Underground Assets not identified by Ms. Utility is your responsibility.

The MowCow Underground Utility Disclaimer:
We are not responsible for damage to what we cannot see. Virginia 811, formally Ms. Utility, only marks underground
municipal utilities such as telephone, natural gas, electric and cable TV lines from main source to the home. Clients are responsible for indicating where invisible dog fence, propane, septic, water, irrigation heads and lines, plumbing lines and/or other underground assets are located. We are not responsible for private electrical lines including, but not limited to, pool pumps, sheds, decorative or yard lighting that are not clearly marked and locations have been clearly
communicated to MowCow.

MowCow Lawn and Landscape Inc cannot be held responsible for Irrigation Systems underground. These are not marked by Miss Utility, and we cannot be liable for these damages. If you are aware of underground irrigation systems in the area we are working, please mark them and we will do our best to avoid damaging them.

Potential Driveway Damages
Sometimes it is required that MowCow Lawn and Landscape Inc use heavy equipment (i.e. cranes, bucket/dump trucks, trucks with trailers, loaders, & power track) onto a customer’s driveway. MowCow Lawn and Landscape Inc does everything in their power not to cause damage to our customer’s driveways. For example, our trained employees will avoid edges of the driveway to minimize potential damage. Our employees will always ensure that the proper and safe setup is performed. However, sometimes damage occurs that is out of our control due to the equipment on driveways (especially older driveways with cracks, flaking and lifting). In this circumstance, we cannot be held liable for the costs of
these damages.

MowCow Lawn and Landscape Inc is fully insured with Liability & Workers Compensation. Our customers can re-quest a Certificate of Insurance prior to any work performed. Our employees take every precaution before starting any job to minimize any potential damages, and assure you that our company has experienced professionals performing work at your residence.

Clean-Up & Mulch Terms & Conditions

Concealed Conditions:

This Agreement is based solely on the observations Contractor was able to make with the Landscaping in its current condition at the time this Agreement was bid. If additional concealed conditions are discovered (i,e- tree/ shrub stumps, tree/shrub roots, rock, stone) once work has commenced which were not visible at the time the proposal was bid, onsite Crew will stop work, contact the Contractor (your POC) and Contractor will then point out these unforeseen concealed conditions to Client so that Client and Contractor can execute a Change Order for any Additional Work that is within Contractor’s perimeters.

Outside of Perimeters:

Needed tree work (i.e. tree/ shrub stump removal, tree/ shrub grinding) is outside of the scope of work that MowCow Lawn and Landscape Inc. is able to perform. Contractor will recommend companies which specialize in this field, to client. Client will need to contact company directly for estimates, scheduling and so forth. Agreement will be made between Tree Company and client, MowCow Lawn and Landscape Inc. is not affiliated with a tree company and will not be a party in the agreement between Tree Company and Client.

Once the conditions have been remedied, Client is responsible for contacting Contractor to schedule project completion.

Rent-a-crew Terms & Conditions

Rent A Crew Service Details
Conditions: This service is priced specifically by time. Estimators can not guarantee that all requested services will be completed. The landscapers will continue to work on the property until the time client has purchased is complete. If the requested services are not completed during the period of time the client has paid for, the client is given the option to purchase additional time listed below at an additional cost. This cost will be at the regular rate, not at a discounted rate.

Only if extra time is purchased, will crew return (or continue) for additional items (service call). The crew will not return for items including but not limited to- dirt settling, rock settling, weed regrowth, items on the priority list that were not completed during the time purchased, weed growth, remaining materials (purchased by client), bamboo removal, ivy removal, etc. Extra time must be purchased for the crew to return. Warranties or guarantees are not offered for the discounted rent a crew service.

Whole Day Rent A Crew:
Landscaper’s arrive on the property in the morning. Drive time (the time it takes for us to drive from the shop to your property and then from your property back to the shop in the afternoon), set up, walkthrough, crew lunch (45 minutes), two 15 minute breaks (or 1-hour lunch break if two 15 minute breaks or not taken) and delivery time (if required) is deducted from the rental time. One day rent a crew is calculated at 16 man-hours, this is equivalent to 2 men for 8 hours or 3 men for 5.33 hours.

Half Day:
Landscaper’s schedules are from first thing in the morning until midday or midday until evening. Rent A Crew half-day is offered to clients based on availability and time of year. Time purchased is a total of 8 man-hours. This is equivalent to 2 men for 4 hours or 3 men for 2.66 hours. Drive time (the time it takes for us to drive from the shop to your property and then from your property back to the shop), set up, walkthrough, and 1 15 minute break is also deducted from time.

For either whole day or half-day Rent A Crew— If the priority list provided by the client has been completed, and the team
has no other tasks, the crew will leave the property early (before all time has been used). No discounts or credits will be given for the early departure. For this reason, we ask that crews are provided a long list of tasks that they can continue to work on during their time on the property. Please provide your sales specialist a list of priorities (in order) in advance so that it can be given to the landscape team.

Concealed Conditions:

Planting Terms & Conditions

Plant Replacement Policy:
Plant Designer will create a Concept plan with client. Concept plans are renderings of design ideas and suggestions. Prior to plant ordering, Designer will review plan with client and incorporate clients change requests and comments to create a
Master Plan. Once Master Plan is written into contract form (this document), any change order, replacement plants or new plants will be billed at clients expense. Installed plan/ design can differ from design. Plants are living things. Shapes, grow pattern, bloom color or size of each plant is different, this includes planted bulbs bloom color and leaf structure.

Plant replacement must fall under warranty agreement, or charge for replacement/new plant is billable to client.
Watering and keeping your new plants healthy is your responsibility MowCow installs high quality, healthy plants. Should a tree or shrub we installed, that was watered according to instructions, fail to survive due to its original health, we will gladly replace it within one year of installation. Our Warranty does not cover Annuls. Perennials are warranted for six months’ post installation. Naturally, this policy cannot cover damage beyond our control including:

• Over or Under Watering
• Physical Damage
• Freeze or Drought Damage
• Pet Damage
• Insect Damage
• Wildlife Damage
• Disease
• Improper Maintenance Practices
• Salt, Snow or Plow Damage
• Boxwood Blight (box blight)

Plants must be in location MowCow planted them. We will not warrant missing or plants client relocated. MowCow staff must examine plants for warranty issues. Plants that are in poor health, will be examined by MowCow and
recommendations will be given. If recommendation includes plant health treatments, these treatments will be billed to client. Plants that have not survived can only be replaced once unless client has had MowCow’s Plant health Care since the date of installation. If our Plant Health Care program has been active since the date of installation, there is a two year two time replacement on each- Shrub and Tree. Perennials are warranted for six months, annuals are not warranted. If plants repeatedly die in a specific location, installing a different variety is suggested and installment of
plants would be charged to client. MowCow can not, for any reason, warranty/ guarantee pruned, planted or
transplanted shrubs/ perennials against boxwood blight. Proper precautions are taken to avoid transmission of
Calonectria pseudonviculata1 fungus but as it is also airborne, transmission is possible and there for not warrantied.
